The decision of Justice Lee in Turner v Tesa Mining (NSW) Pty Limited [2019] FCA 1644 has been overturned on appeal. On appeal, Chief Justice James Allsop determined that security for costs is unnecessary in this class action for underpayment of workers and to uphold the earlier decision would have been contrary to the best interest of the workers/plaintiffs. By reversing the earlier decision, it will reduce the costs the litigation funders incurs in running this and similar class actions and should result in an increase in the median return to plaintiffs
